Terms of Service

These terms govern your use of the Cyphera SDK, the cyphera.io website, and the documentation portal, operated by Horizon Digital Engineering LLC ("we", "us"). By using any of the above, you enter into this agreement with us.
The SDK — Open Source License
The Cyphera SDK and all integration libraries are released under the Apache License 2.0. You are free to use, modify, and distribute the software in accordance with that license. The full license text is available in each repository.
The Apache 2.0 license grants you a perpetual, worldwide, non-exclusive, royalty-free license to use the software for any purpose, including commercial use.
Documentation Portal
Access to the Cyphera documentation portal requires email verification. By signing up, you agree to provide a valid email address. We reserve the right to revoke access to the documentation portal at any time for any reason.
No Warranty
The Cyphera SDK is provided "as is", without warranty of any kind, express or implied, including but not limited to the warranties of merchantability, fitness for a particular purpose, and noninfringement. In no event shall the authors or copyright holders be liable for any claim, damages, or other liability, whether in an action of contract, tort, or otherwise, arising from, out of, or in connection with the software or the use or other dealings in the software.
This is consistent with the Apache 2.0 license terms that govern the SDK itself.
Limitation of Liability
To the maximum extent permitted by applicable law, Horizon Digital Engineering LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:
- Your use or inability to use the SDK or documentation portal.
- Any unauthorized access to or use of your data.
- Any bugs, viruses, or other harmful code that may be transmitted through the software.
- Any errors or omissions in the documentation.
Acceptable Use
When using the cyphera.io website and documentation portal, you agree not to:
- Attempt to gain unauthorized access to our systems or other users' accounts.
- Use automated tools to scrape or overload the website.
- Redistribute gated documentation content without permission.
- Use the service for any unlawful purpose.
Intellectual Property
The Cyphera SDK source code and integration libraries are licensed under Apache 2.0; you receive the rights granted by that license. "Cyphera" and the Cyphera logo are trademarks of Horizon Digital Engineering LLC and are not granted to you by the Apache 2.0 license — please do not use them in a way that suggests endorsement or affiliation.
Documentation portal content (text, diagrams, examples) is provided for your reference under a separate non-exclusive license to view and use internally. Redistribution of gated documentation content requires written permission.
Termination
You may stop using cyphera.io, the documentation portal, and the SDK at any time. We may suspend or terminate your access to the documentation portal at any time, with or without notice, for any reason — including violation of these terms or the Acceptable Use rules above. Termination does not affect the Apache 2.0 license you already received for the SDK, which is perpetual per its own terms.
Governing Law and Dispute Resolution
These terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-law principles. Any dispute arising out of or relating to these terms or your use of the site or SDK shall be brought exclusively in the state or federal courts located in Florida, and you consent to the personal jurisdiction of those courts.
If you are a consumer in the European Union, the United Kingdom, or another jurisdiction whose mandatory consumer-protection laws override this clause, those laws continue to apply.
Changes to These Terms
We may update these terms from time to time. We will note the date of the most recent revision at the top of this page. Continued use of the website or SDK after changes constitutes acceptance of the updated terms.
